By accessing and using NyaaBot ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our Service. These terms constitute a legally binding agreement between you and NyaaBot.

2. Description of Service

NyaaBot provides an artificial intelligence-powered creative engine, including but not limited to image generation, video creation, and interactive chat modes. The Service utilizes sophisticated machine learning models to generate content based on user prompts and inputs.

3. User Accounts

Access to certain features of NyaaBot requires a user account. You agree to provide accurate information when creating an account via Discord. You are responsible for maintaining the security of your account and for all activities that occur under your account. NyaaBot reserved the right to terminate accounts that violate our terms.

4. Subscriptions and Payments

NyaaBot offers various subscription tiers (including "Booster" and "Prime" plans) to enhance your experience. All financial transactions and subscriptions are handled externally through Patreon. By subscribing, you agree to Patreon's terms and conditions. Subscriptions grant you "Energy" (credits) and other perks as described on our pricing page. Use of Discord Nitro Boosts on our official server may also unlock specific benefits.

5. Content and Intellectual Property

AI-Generated Content: Subject to your compliance with these Terms, NyaaBot grants you the ownership of the output generated by the Service based on your prompts. However, you grant NyaaBot a non-exclusive, worldwide, royalty-free license to use, host, store, and reproduce such content for the purposes of providing and improving the Service.

Copyright and Third-Party Rights: The Service utilizes machine learning models trained on vast datasets. You acknowledge that NyaaBot cannot guarantee the copyright status of generated outputs, especially when prompts reference existing copyrighted characters, anime, cartoons, or public figures. You are solely responsible for your use of generated content. Using the Service to recreate copyrighted characters or intellectual property for commercial purposes or in a manner that infringes on third-party rights is strictly prohibited and done at your own risk. NyaaBot disclaims all liability for any copyright infringement resulting from your prompts or use of generated content.

DMCA Policy: NyaaBot respects intellectual property rights. If you believe your copyright has been infringed, please contact us at support@nyaa.bot with a detailed notice in accordance with the Digital Millennium Copyright Act (DMCA).

NSFW Content (Adult Content): The Service may allow the generation of "NSFW" (Not Safe For Work) or adult content. You must be at least 18 years of age (or the age of majority in your jurisdiction) to access such features. By using these features, you represent and warrant that you are of legal age. You are solely responsible for ensuring that your use and consumption of adult content is legal in your jurisdiction. NyaaBot disclaims all liability for any offense, harm, or legal issues resulting from your exposure to or generation of adult content.

Prohibited Content: Notwithstanding the above, you may not use the Service to generate content that is illegal, including but not limited to child sexual abuse material (CSAM), non-consensual sexual imagery, extreme violence, or content that promotes hate speech or discrimination. We reserve the right to monitor, filter, and block any content that violates these safety guidelines.

6. Energy and Credits

"Energy" is a virtual credit system used within the Service. Energy has no monetary value and cannot be exchanged for cash or transferred between accounts. We reserve the right to manage, regulate, and modify the Energy system at any time without liability.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NYAABOT DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYAABOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify, defend, and hold harmless NyaaBot and its developers, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your use of the Service, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity through the use of the Service (including the generation of infringing AI content).

10. Changes to Terms

We may modify these Terms at any time. We will notify users of any significant changes by posting the new Terms on this page and updating the "Last modified" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
